• Trespassing incident leads to collision
A trespassing incident led to a collision that occurred at 8:05 p.m. on Oct. 31.
The O’Brien County Sheriff’s Office reported that a 2016 Chevrolet Silverado driven by Jared James Magnussen, 34, of Paullina, was being chased off a property managed by Michael Ray Radloff, 59, of Primghar. Magnussen, who was allegedly trespassing on the property, got into his pickup and began driving westbound on 240th Street. Radloff attempted to block the road with his Ford F250 so Magnussen and a passenger would not leave the scene. His pickup was still moving eastbound and was unable to stop completely before making contact with the Silverado.
Magnussen then continued to drive westbound around the Radloff vehicle, which caused a significant scrape and indentations on the majority of the driver’s side of the Silverado. The report stated that Magnussen then left the scene of the accident.
Neither driver was injured. Damage to the Silverado was estimated at $15,000 while the F250 sustained $1,000 in damage. No charges were listed on the report.
• Charged twice with assaulting an officer
A Sheldon man has been accused of assaulting a law enforcement officer twice in less than three weeks.
Brandon Lee Nelson, 34, was initially arrested on Nov. 2, when he allegedly assaulted an O’Brien County Sheriff’s jail supervisor, repeatedly striking him in the head. The latest incident is reported to have occurred on Nov. 22, when Nelson allegedly assaulted a uniformed sheriff’s corrections officer.
Nelson faces two charges of Assault on Persons in Certain Occupations with Intent to Injure, a class D felony. Records indicate Nelson had a Nov. 29 court date for the initial assault charge.
The Sheldon man is also scheduled to go on trial on Dec. 14 in connection with several charges resulting from an incident in Sheldon last August. He is accused of Theft-2nd Degree, a class D felony, as well as Burglary of a Vehicle-3rd degree and Sex Offender Registry Violation, both aggravated misdemeanors.
• Arrested following struggle with deputy
A Sibley man was arrested following a struggle with an O’Brien County deputy on Nov. 21.
According to the report, the deputy observed a male subject passed out behind the wheel in the 200 block of Wansink Avenue in Sheldon. The deputy checked on the welfare of the subject, identified as Joseph Lee Daggett, 34, of Sibley, and found him in an impaired state. The deputy patted Daggett for weapons and a struggle ensued. Daggett allegedly would not show his hands and swallowed an unknown amount of what was suspected to be illegal narcotics.
An officer from the Sheldon Police Department arrived to assist and eventually a Taser was deployed. Daggett was taken into custody and transported to the Sanford Sheldon Hospital emergency room. The deputy received minor injuries during the incident.
The sheriff’s office applied for and obtained a search warrant for both blood and urine samples from Daggett to determine the drug and alcohol content. Medical staff at the hospital obtained the blood and urine samples with the assistance of the sheriff’s office. Samples will be sent to the Iowa DCI Lab for further testing.
Daggett was treated and released from the hospital and booked into the O’Brien County jail on the following charges: Obstructing Prosecution, an aggravated misdemeanor; Interference with Official Acts-Causing Bodily Injury, a serious misdemeanor; Possession of a Controlled Substance-3rd or subsequent offense, Methamphetamine, a class “D” felony; and Possession of Drug Paraphernalia, a simple misdemeanor. Additional charges are pending further investigations and lab results.
Daggett went before the magistrate on Nov. 21 and bond was set at $5,000. Bond was posted and he was released on Nov. 22.
• Loses control of pickup on curve
The O’Brien County Sheriff’s Office reported that a Ford F150 pickup driven by Benjamin Jay Kamphoff, 40, of Cleghorn, was eastbound on 460th Street on Nov. 21 at 9:29 p.m. Kamphoff failed to keep the pickup under control where the road begins to turn left at the bottom of a hill. It ran off the road to the right, entered the ditch sideways and rolled before going airborne and coming to rest on the roof.
According to the report, a witness who arrived at the scene within seconds of the accident observed Kamphoff walking around in the trees. It is believed that he was ejected through the windshield which came to rest on top of the upside down pickup. Limbs were damaged approximately 12 feet high in the trees.
Kamphoff was transported by Sutherland Ambulance to the Cherokee Regional Medical Center for treatment of minor/non-incapacitating injuries. Damage to the pickup was estimated at $5,000. Kamphoff was cited for Failure to Maintain Control and Failure to Maintain or Use Safety Belts-Adult.
