• Faces OWI charge
The Hartley Police Department received a call that indicated a person may have been driving under the influence. After locating the vehicle at Brew Oil, the officer followed the vehicle and stopped it because he knew the license of the driver, Aaron Sweet, 45, was not valid. An odor of alcohol was detected and Sweet failed field sobriety tests.
Sweet was charged with Operating While Intoxicated. The charge is a class D felony since he had been convicted at least twice before. A preliminary hearing was scheduled for May 5.
• Charged with drug possession in jail
A criminal complaint was filed by the Sanborn Police Department against Johnathon Emmons, 20, of Sanborn, who was arrested on April 30.
The complaint states that during the booking process for another charge, a scan was conducted and a small spoon and a round metal container with a waxy substance were found on Emmons. The substance tested positive for marijuana.
Emmons was charged with Possession of Contraband in a Correctional Facility, a class D felony. He was held at the O’Brien County Jail awaiting a preliminary hearing on May 22.
• Clay County traffic stops result in arrests
A Clay County deputy initiated a traffic stop on May 6 in the 3000 mile of Highway 18. Upon investigation, the deputy smelled the odor of marijuana emanating from the vehicle. A search of the vehicle located marijuana.
The driver, Andrea Mendez Figueroa, 23, of Rockwell City, was arrested and charged with Possession of a Controlled Substance-Marijuana, a serious misdemeanor; and Speeding and No Insurance, simple misdemeanors. She was released from jail on bond.
During a traffic stop on May 6 in the 3400 mile of 160th Avenue, a deputy determined that Dane Kramer, 34, of Spencer, had been consuming alcoholic beverages. He was run through a series of field sobriety tests.
Kramer was charged with Use of Electronic Device While Driving, a simple misdemeanor; and OWI-2nd Offense, a serious misdemeanor. Kramer was held in the county jail to appear before the magistrate.
Orlando Marte Reves, 22, of Schaller, was arrested during a traffic stop on May 7 in the 4500 mile of Highway 71. During the investigation it was determined that he had a suspended driver’s license.
Marte Reves was charged with Driving Under Suspension, Failure to File S.R. Insurance and Speeding, all simple misdemeanors. He was released from jail on bond.
• Arrested for probation violation
Max Hellert, 24, was arrested at the Clay County Sheriff’s Office on May 7, on a warrant for Probation Violation-Must Serve 2 Days. He was held in the county jail without bond.
• Vehicle strikes guardrail
The Clay County Sheriff’s Office responded to an accident at 2:15 a.m. on May 6. According to the report, a 1994 GMC Sierra driven by Taylor Einck, 33, of Primghar, was westbound in the 2000 mile of Highway 18 when it veered across the eastbound lane and struck a bridge guardrail.
Einck was transported to Spencer Hospital for serious injuries. The Sierra is considered a total loss. The report stated that the accident is under investigation and charges are expected. Spencer Police Department, Spencer Fire Department and Fostoria First Responders assisted at the scene.
• Shelf causes damage in Clay County accident
The Clay County Sheriff’s Office investigated an accident that occurred at 7:44 on May 6. The report stated that Roger Updike, Jr., 59, of Spencer, was driving a 2008 Ford F150 pulling a trailer westbound on 400th Street. A couch and a shelf fell off the trailer, and the shelf struck a 2014 Chevrolet Cruze driven by Stephanie Drzycimski, 20, of Alta, which was eastbound.
No injuries were reported. Damage to the Cruze was estimated at $3,500. Updike was cited for Failure to Secure Load.
